Effective from:
§ 1. General provisions
- These Terms of Service set out the rules for using the browser game Torvidia (the “Game”), available at .
- The operator of the Game and the service provider is , a sole proprietorship run in Germany by , (the “Operator”). Contact: , phone . Full Operator details: Impressum.
- The Game is a digital service provided electronically. The contract for the provision of this service is concluded for an indefinite period upon completion of account registration, during which the Player ticked the box confirming acceptance of the Terms of Service.
- If the Player does not accept the Terms of Service, they may not create an account or use the Game. Creating an account constitutes acceptance of the Terms of Service.
- To use the Game you need: a device with internet access, an up-to-date browser with JavaScript and cookies enabled, and an email address.
§ 2. Player account
- An account may be created by a person who has reached the age of 16. A younger person may use the Game only with the consent of a parent or legal guardian. When registering, the Player declares that they meet this condition.
- When registering, the Player provides a character name, an email address and a password. The email address must belong to the Player and be up to date – the Operator sends account-related information to this address.
- The Operator sends messages about the account and the use of the Game to the Player's email address (e.g. account security, changes to the Terms of Service, important changes to how the Game works). Messages about news, events and promotions in the Game are sent by the Operator only to Players who have given separate, voluntary consent by ticking the box during registration or in Settings → Messages. Not giving this consent does not restrict the use of the Game. Consent can be withdrawn at any time in Settings or via the link in each such message.
- One person may have one account in the Game. Creating and using multiple accounts (so-called multi-accounts) is prohibited.
- Several people playing from the same household, connection or device report this in Settings → Multi-account (one account invites, the other confirms). Reported accounts and accounts playing on the same device may not buy from each other or attack each other in the Arena; transferring gold or items to each other in any other way (e.g. via a guild or deliberately lost fights) is prohibited.
- The account is personal. Sharing, selling, exchanging or transferring the account to other persons is prohibited.
- The Player is responsible for keeping their password confidential and for all actions performed from their account. The Operator never asks for a Player's password.
- Character names, guild names and descriptions, and other content entered by the Player must not be vulgar or offensive, infringe the rights or personal rights of third parties, impersonate the Operator or its team, or contain advertising. The Operator may change or remove any such name or content.
§ 3. Game rules
- The following is prohibited:
- using bots, scripts, macros and any programs that automate gameplay or send requests to the Game on the Player's behalf;
- exploiting bugs in the Game – any bug found must be reported to the Operator without delay;
- colluding with other players to artificially transfer gold, items or experience (including fixing fights and market transactions at grossly understated or inflated prices);
- trading accounts, currency and items from the Game for real money or other benefits outside the Game;
- attempting to gain unauthorized access to the Game, its servers or other players' accounts, as well as actions that disrupt the operation of the Game;
- insulting, harassing and threatening other players, as well as sending spam and advertising in messages, in chat and in descriptions.
- The Operator decides whether a violation has occurred on the basis of the technical data available to it and the course of gameplay.
§ 4. Development and changes to the Game
- The Game is a continuously developed entertainment environment. The Operator may at any time, without prior notice, change the content and mechanics of the Game, in particular: game balance, the statistics and appearance of characters, items and opponents, merchants' prices and stock, rewards, chances, timings, events and rankings, as well as add new features and remove existing ones.
- The changes referred to in para. 1 are part of the nature of the Game and do not constitute an amendment to the Terms of Service or the contract. The Player has no claims on account of them, including claims to restore an earlier state or for compensation.
§ 5. Virtual items and currencies
- Characters, gold, diamonds, items, scrolls, materials and other elements of the Game (“virtual goods”) are virtual. The Player does not acquire ownership of them. The Operator grants the Player only a non-exclusive, non-transferable right to use the virtual goods within the Game for the duration of the contract and in accordance with the Terms of Service.
- Virtual goods have no monetary value, cannot be exchanged for money or resold, and may not be transferred outside the Game.
- The Operator may modify, transfer, merge, remove or reset virtual goods if this is required by the development of the Game, gameplay balance, the elimination of a bug or abuse, or technical reasons. The Operator will announce a complete reset of all players' progress (e.g. a new server or season) in the Game at least 30 days in advance.
- Virtual goods obtained as a result of a bug in the Game, abuse or a violation of the Terms of Service may be reversed or removed by the Operator without compensation.
§ 6. Purchase of diamonds
- The Game is free. The Player may optionally buy diamonds – the Game's additional currency – in VIP account → Buy diamonds. Diamonds can also be earned in the Game without paying.
- Package prices are shown next to each package in Polish złoty (PLN) and are final prices. The number of diamonds is also shown next to each package; during in-Game events, packages may include extra diamonds.
- Payments are processed by Stripe Payments Europe, Ltd. (Ireland). The available payment methods (e.g. card, BLIK, Przelewy24) are shown on the Stripe payment page. The Operator does not receive or store card or bank account details.
- The contract is concluded when Stripe confirms the payment. The diamonds are credited to the account of the character used for the purchase, usually within a few moments, and the Player receives a message about it in the Game. Diamonds work only in the Game world in which they were bought.
- Diamonds are digital content. A consumer may withdraw from the contract within 14 days of its conclusion without giving any reason. The right of withdrawal expires once the diamonds are credited to the account if, before the purchase, the Player expressly requested immediate delivery and acknowledged the loss of the right of withdrawal by ticking the consent box at purchase. The Player receives confirmation of this consent in an in-Game message together with the purchase confirmation.
- A minor may buy diamonds only with the consent of a parent or legal guardian.
- If a payment is reversed (refund, chargeback), the Operator may deduct the corresponding diamonds from the account and, if they have already been spent, temporarily block the account until the matter is resolved.
- The Operator handles complaints about purchases (e.g. diamonds not credited) within 14 days; if the diamonds were not delivered, the Operator delivers them or refunds the payment. In your complaint, state the character name, the date and the amount of the payment and send it to .
§ 7. Violations, bans and moderation
- In the event of a violation of the Terms of Service, accepted standards of conduct or the law, the Operator may, at its own discretion depending on the severity and recurrence of the violation: warn the Player, remove or change prohibited content, restrict access to chat or other features, reverse unfairly obtained benefits (items, gold, diamonds, statistics, ranking positions), temporarily ban the account, or ban it permanently and terminate the contract with immediate effect.
- In the event of a serious or persistent violation (in particular bots, multi-accounts, exploiting bugs, trading for real money, fraud, hacking), the Operator may ban the account immediately, without a prior warning.
- After an account is permanently banned due to the Player's violation of the Terms of Service, all virtual goods on that account are forfeited, including unused diamonds, subject to mandatory provisions of law.
- The Operator informs the Player of a restriction, ban or removal of content in the Game, upon a login attempt or by email, stating the reason for the decision and the rule that was violated, unless this is prohibited by law or precluded by security considerations.
- The Player may appeal against a decision by writing to within 14 days of receiving it. The Operator will consider the appeal within 14 days. The decision taken after considering the appeal is final within the Game.
- Anyone may report content that is unlawful or violates the Terms of Service to the Operator at , indicating where it is located and why it violates the rules. The Operator handles reports without undue delay and informs the person who submitted the report of the decision.
§ 8. Availability of the Game and liability
- The Operator makes efforts to keep the Game running but does not guarantee its uninterrupted or error-free availability. Technical breaks, updates, maintenance work and outages may occur at any time.
- In the event of an outage, bug or abuse, the Operator may restore the state of the Game or of an account from a backup taken at an earlier point in time and reverse the effects of events from that period. The Player has no claims on this account to restore lost progress or for compensation.
- The Operator's liability for damage caused by simple negligence is excluded, unless it concerns a breach of a material contractual obligation, i.e. an obligation whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance the Player may regularly rely. In such a case, the Operator's liability is limited to the typical damage that was foreseeable at the time the contract was concluded.
- The limitations in para. 3 do not apply to liability for injury to life, body or health, for damage caused intentionally or through gross negligence, or to liability that cannot be excluded under mandatory provisions of law.
- The Operator is not liable for the consequences of the Player sharing their login details with third parties, or for interruptions caused by circumstances beyond its control (e.g. failures of internet or hosting providers, attacks on servers).
§ 9. Content added by players
- The Player is responsible for the content they publish in the Game (names, messages, chat, guild descriptions and other content).
- By publishing content in the Game, the Player grants the Operator a free-of-charge, non-exclusive, territorially unlimited license to store it, display it to other players, moderate, modify and delete it, and to use it to the extent necessary to operate and promote the Game, for as long as the content exists in the Game.
- The Operator is not obliged to review players' content, but may moderate it at any time in accordance with § 7.
§ 10. Termination of the contract and account deletion
- The Player may stop using the Game at any time and request deletion of their account by writing to from the email address assigned to the account.
- Deleting an account is irreversible and means the loss of the character and all virtual goods.
- The Operator may delete an account that nobody has logged into for at least 12 months, after prior notice sent to the Player's email address at least 14 days in advance. Logging in during this period preserves the account.
- For accounts on which the Player has not made any payment, the Operator may terminate the contract at any time, without giving reasons, subject to a 7-day notice period. The Operator gives notice of termination in the Game or by email. After this period expires, the account, together with the virtual goods and progress in the Game, is permanently deleted.
- The Operator may terminate the contract with all players and discontinue the Game, announcing this in the Game at least 30 days in advance.
- The Operator's right to terminate the contract with immediate effect for good cause (§ 7) remains unaffected.
§ 11. Prawa autorskie
- The Game, its code, graphics, texts, names and visual design are protected by copyright and belong to the Operator or are used by it under license.
- Copying, distributing and modifying elements of the Game without the Operator's consent is prohibited, except for permitted use as provided for by law.
§ 12. Personal data
The rules for processing personal data and using cookies are set out in the Privacy and Cookie Policy.
§ 13. Changes to the Terms of Service
- The Operator may amend the Terms of Service for important reasons, in particular: changes in legislation or case law, the introduction of new features or services (including paid ones), technical or organizational changes or changes relating to security, and the prevention of abuse.
- The Operator announces any amendment by a notice in the Game or by email at least 14 days before it takes effect.
- A Player who does not accept the amendments may terminate the contract and delete their account before they take effect. Continued use of the Game after the amendments take effect constitutes acceptance of them.
- Changes to the content and mechanics of the Game (§ 4) are not amendments to the Terms of Service and do not require prior notice.
§ 14. Governing law and final provisions
- The contract and the Terms of Service are governed by the law of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). In the case of a consumer, this choice of law does not deprive them of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
- Disputes with consumers are settled by the court having jurisdiction under the general rules.
- The Operator is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
- If any provision of the Terms of Service proves to be invalid or ineffective, the remaining provisions remain in force.
